Has anyone read this lately? I used to have their TOS memorized and I hadn't noticed that they replaced it with a new one.
So now, if we delete our accounts of our own accord, we lose access to all of our game purchases and PlayGold??? I had seen some people mention that previously, but I didn't really pay attention.
I can't even understand that if PF cancels an account.
If you pay money for something, it should be yours. Not if you pay money for it, it is your opportunity to access the object until such a time as it is taken away for whatever reason!!!
So we are no longer buying the games. We are buying access. Unless we purchase a back up disk.
That stinks. In that case, they should just sell the disks. Has anyone tried just buying a disk? Will the payment system let you?
PlayGold is also non-refundable and the property of PlayFirst according to the TOS. Should they choose to discontinue the program, they will give you 10 days to use it up. So it really isn't yours either.
I think this is strange considering PF is in California. There was a huge lawsuit there a couple of years ago, regarding buying 'the right' to something, such as a service via a gift card or gift certificate, where it had an expiration date. The court there said that if you "buy" money, it does not expire and you are entitled to the service/object for which you bought the gc for an unlimited time without expiration....although they can charge you service fees on a gift card.
Obviously, this isn't a problem for most of us, as we aren't cancelling or having our PF account cancelled. All the same, I don't think thats right.
Four times in less than 2 weeks I have been unable to play any of my PF games due to their server problems. I get a message that state I have to be able to contact PF in order to play this game. I am online at their site at the time so it's not a connection problem from my end. It does make me consider if I want to purchase a game from them or not.
I have noticed that some of the games that are bought recently can only be downloaded 3 times. I can't figure how this is fair since I paid in full for them. I should be able to download my games as much as I want. what difference can it possibly make to them if I download it once or 100 times. The disc take space to store, and I want my game "now". That's why I liked the ability to download. Maybe PF isn't thinking this thing through. I found a site called retro64.com that have some of the same games with not download limits.
Should we mention this to PF? I don't usually go to the site as much usless I get a firstpeek or I'm downloading for my DDHH.

Latte, I would think if they make a change to their TOS (as they obviously did in 10/08) they should send out some kind of announcement, either via email or in the forums. How many of us ever go back to re-read it after joining to see if any changes are there? I know I haven't. And what makes this so crazy is that if you wait for their games to be released on different portals, BFG for example, you can get them at a much lower price AND they are actually yours to keep! Go figure!!
The three downloads thing has always been the "policy" however, if you just contact Customer Service at any of the sites that have that limit (and most of them do, to be honest) they will re-open your key for you, as long as you have your original receipt/key or the purchase is recorded on their site, or if they can track it on your cc.
I don't have a problem with these new PF policies per se, if they had been announced and if any game purchases prior to the announcement were retro'd to old policy.
If I choose to close my account, I should have full access to my games. Grant it, yes, I can just leave my account open and not access it, but that is keeping me from something I paid for, should I decide for whatever reason to close it....
As for the server thing Rob, I read on the internet that the company that PF uses to host their server is having possible bankruptcy issues... don't know if that has any relevance or is related....so that's probably a temporary issue that will either be fixed by that particular company or by PF moving to a new host...OR could have nothing to do with nothing.....and maybe you just caught PF in the middle of working on something...
I guess since I don't plan on canceling my PF account anytime soon I am okay but what happenes if PF for some reason ceases to exist? I will lose everything I paid for through no fault of my own. That is just wrong!

Well, I think it generally stinks. If I buy it, it is mine and access should be unlimited. Further, I have had the same problem as Rob, especially when playing the new Chocolatier. If PF wants to amend their TOS it should be clearly announced.

I have always thought that the policy of only being able to download a game three times from a company once you have paid for it in full, is b u l l s h i t! I don't know what the issues are on the side of the company's. but if they automatically only want to download it three times, a hardcopy should automatically (AUTOMATICALLY) be sent to the purchaser. That is customer service. Everything is greed on the part of the company, but it's been going on a long time with a lot of companies, and I've never heard anyone put up a fuss about it, and I don't understand why either.
Recently, I've had a related problem to this "service" of only downloading your own game three times before you have to buy it again (Hmmf! Service!) where the company has disappeared, and I have jumped through hoops and waited for days, before a message was sent to me where I could find a copy of MY game, and have then downloaded it from some site I have never heard of. Seems like very poorly run companies, and it seems like it's what you can expect more and more. Disgruntling.
